BASIC SCIENTIFIC CONCEPTS OF SOVEREIGNTY: THE CLASSICAL DOCTRINE AND THE DEVELOPMENT OF MODERN LEGAL CONSCIOUSNESS

Abstract

The article is dedicated to basic scientific concept of essence of sovereignty. In this article in detail is held analysis of philosophical and legal theoretical concept of sovereignty. Submitted overview following concepts of sovereignty: theory sovereignty of absolute state, democratic theory of sovereignty, theory representation folk sovereignty, teaching about formally legal understanding of sovereignty and others. Author analyses features understanding of sovereignty in modern russian legal science. Justified the author’s concept of sovereignty as a natural public law on basis number of characteristics of sovereignty (sovereignty belongs subjects of public legal relations, carriers of sovereignty are subjects of authority, source authority can exist without sovereignty and others).
